До Европейския парламент, Европейската комисия, Съвета на Европейския съюз, Европейската служба за борба с измамите (OLAF), Европейската прокуратура, Представителството на ЕК във Виена
Уважаеми дами и господа,
с настоящето писмо се обръщаме към Вас с молба да обърнете внимание на
случващото се в България относно предаването на българската съдебна система и други ключови институции в ръцете на олигархична мафия.
През последните няколко месеца лидерът на партия Да България Христо
Иванов, репортерите от Биволъ, организация Боец, както и други организации и кампании съставиха една безпрецедентно ясна картина, как един кръг от олигарси ефикасно е успял да създаде паралелна държава в България, която упражнява властта чрез бизнеса, съдебната система, медиите, полицията и апаратурата за сигурност. Българската мафия произхожда от Държавна Сигурност - шпионската служба от епохата на комунизма - и се възползва от безсилието на съдебния надзор на ЕС, като по този начин успя да разшири обхвата си, използвайки известната от онова време тактика на заплахи и компромати.
Най-големите проблеми са свободата на медиите и правосъдната система.
Появяват все повече сведения за това, че съдебната система в действителност е инструмент за заплахи, изнудвания и държавни превземания. Десетките хиляди протестиращи по улиците на София и други градове, които ние подкрепяме призовават не само за оставката на Борисов, но и главния прокурор Иван Гешев. Свидетели сме за това как Европейските лидери мълчат относно очевидно нарастващите доказателства, че една страна от ЕС нагло се противопоставя срещу демократичните и правни норми на блока, както и че не успяват да критикуват София заради бруталните действия на полицията спрямо протестиращите и атаките срещу журналисти.
Смятаме,че ЕС трябва да бъде способна да гарантира минимални норми за
върховенство на закона в държава-членка, каквато е България. Вместо това
изглежда, че Европейската комисия, която трябва да действа като гарант на
договорите на ЕС, умишлено си затваря очите за случващото се в България,
макар и за всички да е очевидно, че европейските фондове са жизнената сила на мафията. Това ниво на превземане на държавата в България стана възможно само чрез лесното и безконтролно използване на средства от ЕС.
Нарушенията на правовата държава в България са проблем, включително за ЕС. Страната е в хаос, и то въпреки съществуването на механизма на ЕС за
сътрудничество и проверка на съдебната реформа и борбата с корупцията.
Комисията дава на България странно позитивни оценки и доклади, докато в
същото време фактите сочат, как поглъщането на държавата от мафията се
задълбочава.
Като омекотява надзора върху съдебните реформи и едновременно с това
подклажда корупцията чрез европейски фондове, доверието в ЕС е поставено под въпрос. Бездействието на лидерите на ЕС и на Европа по отношение на ситуацията в България може да доведе до засилено отчуждение и евроскептицизъм сред младите граждани на Съюза в България (но не само), където доверието в институциите на Брюксел обикновено е по-голямо, отколкото в националните правителства, и едно от най-високите в ЕС.
Какво цели нашият протест?
Искаме официална позиция от страна на ЕС по следните въпроси:
- липсата на съдебна реформа в България;
- съмненията за срастване на съдебната с изпълнителната власт в България;
- съмненията за злоупотреби със средства от фондове на ЕС от страна на
изпълнителната власт;
- силно ограничената медийна свобода в България;
- абсолютният провал на правителствата на Борисов в борбата с корупцията.
Въпросът е защо се подкрепя правителство, което позволява това?

Letter to the European Parliament, the European Commission, the Council of the European Union, OLAF and the European Public Prosecutor

Dear Madam, dear Sir,
With the present letter we would like to request the European Union to take into consideration the situation in Bulgaria where the Judiciary and other main and fundamental authorities and institutions have fallen into the hands of an oligarchic mafia.
During the past few months, the leader of the party “Yes, Bulgaria” Hristo Ivanov, the reporters of the news site “Bivol’’, the organization “Boets” and other organizations and campaigns have made it clear that a circle of oligarchs has managed to establish a parallel state in Bulgaria, where they rule through business, the Judiciary, the media, the police forces and the security services. The Bulgarian mafia originates from the Bulgarian spy services in the age of communism called „State security”. Eased by the weak judicial oversight of the European Union, it has succeeded in expanding its influence by using the well-known communist methods of threat and pressure.
The biggest problems in Bulgaria are the absence of freedom of the media and the judiciary. There is more and more evidence that the Bulgarian Judiciary is an instrument of extortion by threat, blackmail and state takeover.
Tens of thousands people, whom we support, are protesting in Sofia and other Bulgarian cities, not only against government of Boiko Borissov, but also calling for the resignation of the main prosecutor Ivan Geshev.
We are witnessing the European leaders’s silence regarding the growing evidence that one of the EU Member States insolently opposes its legal and democratic norms and rules. In Sofia the police committed brutal acts against protesters and journalists and yet the European leaders have failed to criticize Bulgaria for such illegal actions.
We consider that the EU must be capable of guaranteeing minimal norms of rule of law in its Member States, one of which is Bulgaria, and that the European Commission must be capable of enforcing EU’s agreements. Instead of this, it seems that the European Commission chooses to close its eyes to the situation in Bulgaria, although it is obvious that the European funds are the life-force of the mafia. This level of occupation of the Bulgarian state by the mafia became possible with the easy and uncontrolled use of the money from the European funds.
The violations of the rule of law in Bulgaria are a problem for the European Union as well. The country is in chaos, in spite of the EU‘s cooperation mechanism in the area of judicial reform and fight against corruption. The Commission gives Bulgaria astonishingly positive reports and assessments, while at the same time the facts show deeper and deeper absorption of the state by the mafia.
The weak oversight over the judicial reform and the increase of corruption through the European funds call in question the trust in the European Union. The inaction of European leaders regarding the situation in Bulgaria may lead to an increased alienation and euroscepticism especially among the young citizens of the Union in Bulgaria, where the trust in Brussels institutions is usually higher than in the national ones.
What is the purpose of our protest? We expect the EU to take an official position on the following issues:
- the lack of effective judicial reform in Bulgaria,
- the suspicions of merging between the judiciary and the executive authority in Bulgaria,
- the suspicions of misuse of European funds by the executive authority in Bulgaria,
- the severe limitation of freedom of speech in Bulgaria,
- the total failure of Borissov‘s government in the fight against the corruption.
The question is: why is a government making all of this possible supported?

An das Europäische Parlament, die Europäische Kommission, den Rat der Europäischen Union, das Europäische Amt für Betrugsbekämpfung (OLAF), die Europäische Staatsanwaltschaft, die Vertretung der Europäischen Kommission in Wien
Sehr geehrte Damen und Herren,
mit diesem Brief fordern wir Sie auf, Ihre Aufmerksamkeit auf das Geschehen in Bulgarien und das Übergeben des bulgarischen Rechtssystems und anderer Schlüsselinstitutionen in die Hände einer oligarchischen mafiaähnlichen Struktur zu richten.
In den letzten paar Monaten haben Hristo Ivanov, Vorsitzender der Partei „Da Balgaria“, die Reporter von Bivol, die Organisation Boez sowie andere Organisationen und Kampagnen ein gestochen scharfes Bild gezeichnet, wie ein Kreis von Oligarchen effektiv einen Parallelstaat in Bulgarien aufgebaut hat, der durch Wirtschaft, Gerichtssystem, Medien, Polizei und Sicherheitsapparat Macht ausübt. Die bulgarische Mafia geht aus „Darzhavna sigurnost“ – ein Spionagedienst aus der kommunistischen Ära – hervor, und nutzte die Ohnmacht der Gerichtskontrolle durch die EU, um erfolgreich ihr Wirkungsfeld mittels der aus der damaligen Zeit bekannten Einschüchterungs- und Kompromittierungstaktik auszuweiten.
Die größten Probleme sind die engeschränkte Medienfreiheit und das Gerichtssystem. Es mehren sich Hinweise dafür, dass das Gerichtssystem in Wahrheit ein Instrument für Einschüchterung, Erpressen und Staatsübernahmen ist. Die Zehntausenden Protestierenden auf den Straßen Sofia‘s und anderer Städte, die wir unterstützen, rufen nicht nur zum Rücktritt von Borissow, sondern auch von dem Hauptstaatsanwalt Iwan Geschew auf. Wir sind Zeugen dessen, dass die europäischen Staatsoberhäupter trotz der sich mehrenden Beweise, dass ein EU-Land frech die demokratischen und rechtlichen Normen der Union missachtet, schweigen, sowie dass sie sich zu keiner Kritik an Sofia angesichts der brutalen Handlungen der Polizei gegenüber Protestierenden und der Angriffe gegen Journalisten durchringen.
Wir vertreten die Meinung, dass die EU in der Lage sein sollte, Mindestnormen des Rechtsstaates in einem Mitgliedsland wie Bulgarien zu garantieren. Stattdessen sieht es so aus, dass sich die Europäische Kommission, die die Einhaltung der Verträge mit der EU garantieren soll, absichtlich die Augen für das Geschehen in Bulgarien verschließt, obwohl es offensichtlich ist, dass die europäischen Gelder das Lebenselixier der Mafia sind. Dieses Ausmaß der Vereinnahmung des Staats in Bulgarien wurde nur durch das leichte und unkontrollierte Nutzen von Mitteln aus der EU möglich.
Die Rechtsstaatsverletzungen in Bulgarien sind ein Problem, auch für die EU. Das Land ist in Chaos, und das trotz des Existierens des EU-Mechanismus für Kooperation und Kontrolle der Rechtsreform sowie des Kampfs gegen die Korruption. Die Kommission vergibt Bulgarien eigenartig positive Noten und Berichte, während gleichzeitig die Fakten zeigen, dass sich das Verschlucken des Staats durch die Mafia vertieft.
Die Lockerung der Kontrolle der Rechtsreform und das gleichzeitige Befeuern der Korruption durch die Gelder aus den europäischen Fonds stellen das Vertrauen in die EU unter Fragezeichen. Die Untätigkeit der Staatsoberhäupter der EU und Europa bezüglich der Situation in Bulgarien können zu einer verstärkten Entfremdung und Euroskeptizismus der jungen Bürger der Union in Bulgarien (und nicht nur) führen, obgleich in Bulgarien das Vertrauen in den Institutionen in Brüssel üblicherweise höher ist, als in den nationalen Regierungen, und eine der höchsten in der EU ist.
Welche Ziele hat unser Protest? Wir fordern eine offizielle Stellungnahme seitens der EU zu folgenden Themen:
- die ausbleibende Rechtsreform in Bulgarien
- die Hinweise auf die Verflechtung der Gerichts- und der Exekutivmacht in Bulgarien
- die Hinweise auf Missbrauch der Gelder aus der EU-Fonds seitens der Exekutivmacht
- die stark eingeschränkte Medienfreiheit in Bulgarien
- das Totalversagen der Regierungen von Borissow gegen die Korruption.
Die Frage ist, warum wird eine Regierung unterstützt, die das duldet?
